Conditions of Sale Febvre & Company Limited supply goods on the terms set out herewith and at the company’s sole discretion, these terms may supersede all other terms and conditions historically offered. Prices :- Prices of goods delivered will be those prices prevailing at date of dispatch exclusive of VAT which will be added at the prevailing rate. Febvre reserves the right to pass on changes in Customs & Excise duties and payment for all goods shall be made in accordance with the terms set out by Febvre. Payment:- Credit will be considered on application.Until credit is approved/granted all orders will need to be paid prior to collection or at time of order. All accounts approved for credit will have a credit limit applied to their account. No other payment terms will be accepted whether given in the past or otherwise, unless expressly agreed with Febvre in writing. In the absence of any agreement in writing, the terms of payment remain as stated in Febvre ‘s terms & Conditions of sale. Febvre & Co Ltd reserve the right to withdraw credit/credit limits at any time without notice. Payment Method:- Accepted payment methods include cash, direct debit, electronic transfer, credit/debit card, draft & cheque. Overdue Monies:- Overdue monies will be liable to interest at the maximum rate allowed by applicable law. Febvre reserves the right to seek recovery of any legal cost incurred in collecting overdue sums owing to Febvre. Retention of Title (“all monies clause”). Febvre operates an “all monies clause”. Title of goods represented by each of Febvre & Company’s invoices, shall only pass from Febvre & Company Limited to the buyer when the buyer has paid Febvre & Company Limited in cleared funds the invoice value of those specific goods and the invoice value of all other goods Febvre & Company Limited have sold or agreed to sell to the buyer. Proof of Delivery:- Goods signed for by customers are taken to have been checked-in by the customer or his agent and deemed to have been delivered in full and good condition. At this point risk in the goods is deemed to have passed to the customer who is now responsible for these goods, albeit that the goods remain the property of Febvre & Company limited until paid for in full. Breakages, Shortages:- Claims for breakages, damaged stock or shortages, will not be accepted unless clearly marked otherwise on the proof of delivery. The customer must submit a claim for breakages, damaged stock and shortages within 24 hours of receipt of goods. The credit request must replicate the issue clearly marked on the delivery note. A claim can be made by contacting the customer service department or the relevant sales representative. Returns Policy:- No returns will be accepted unless they are faulty, damaged in transit or incorrectly supplied. All other goods that are returned will be subject to a 40% restocking charge. Returns subject to the 40% restocking charge will not be accepted unless first authorized by the Office or by the Sales person in charge of the customer’s account. Relevant uplift documentation must be issued before a return will be accepted. Should a return be required, then a call must first be made to the sales person responsible or to the customer service department. Responsibility:- Febvre & Company Limited will have no responsibility whatsoever for any returns made without prior consent. These returns will not be accepted and will be put to one side for collection by the client. Goods not collected within 30 days will be destroyed or resold to defray administrative costs associated with managing unregulated returns. Promotions:- Goods purchased on special promotion or any other special offers are not applicable for return unless damaged or incorrectly supplied. Collection Cost:- Upon agreement to uplift, Febvre will produce the relevant uplift documentation. All returned goods must be accompanied by a proof of purchase (Copy of invoice /POD acting as receipt) and the relevant uplift docket. Uplift dockets must be signed by the Customer and the Febvre driver. Goods returned without correct documentation will not be accepted. An uplift charge equal to the uplift cost only, will be credited to client accounts. Carriage:- The minimum order is €300 (ex VAT), all orders below this amount will be subject to a delivery charge of €15 in and outside of Dublin. The cut off time for orders outside Dublin is 2pm and inside Dublin 5.30pm for next day delivery. Any orders placed after these times will be placed on a delivery schedule for the following working day. Vintages:- Vintages as described in our price list are subject to stock availability and may change without notice.
